These Terms of Service (“Terms”) form a binding agreement between Linguine Technologies Ltd (“Linguine”, “we”, “us” or “our”), a company incorporated in England & Wales with company number 17317847, and the person or entity accessing or using our services (“you”, “your” or “Customer”). By creating an account, signing an order form, or using any part of the Service, you agree to these Terms.
Linguine provides an AI-powered voice agent that answers inbound phone calls to your restaurant or hospitality venue, takes reservations, answers routine enquiries, hands calls off to your team when required, and synchronises resulting bookings with your existing reservation systems (the “Service”). Specific features, integrations, call volumes, and voice options are described on our website or in your order form and may evolve over time.
You must provide accurate account details, keep credentials confidential, and promptly notify us of any unauthorised use. You are responsible for all activity under your account and for the acts and omissions of your authorised users.
You will not, and will not permit others to:
Subscription fees are set out on our pricing page or your order form and are quoted exclusive of VAT and any other applicable taxes. Fees are billed monthly in advance and are non-refundable except where required by law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
The Service processes and may record inbound calls to your published phone number in order to transcribe, respond, and create bookings. You are responsible for informing your callers that calls to your venue may be answered, recorded, and processed by an automated system, and for obtaining any consents required by applicable law (including the UK GDPR and the Privacy and Electronic Communications Regulations 2003). We provide standard notice language on request.
When we process personal data of your callers on your behalf, you are the “controller” and we are a “processor” for the purposes of the UK GDPR. Our Privacy Statement describes how we handle personal data. A Data Processing Addendum is available on request.
Linguine and its licensors retain all right, title, and interest in and to the Service, including all software, models, prompts, brand elements, and documentation. You retain all rights in your own content, venue data, and configurations. You grant us a limited, non-exclusive licence to host, use, and process that content solely to provide the Service.
The Service is built on third-party infrastructure and models, including (without limitation) ElevenLabs (speech synthesis), Anthropic (large-language-model inference), and Cloudflare (network and compute). We select and manage these sub-processors, but their availability, performance, and terms are ultimately outside our control.
We will provide the Service with reasonable skill and care. Except as expressly stated in these Terms, the Service is provided “as is” and we disclaim all other warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will always be accurate.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law. Subject to that, our total aggregate liability to you under or in connection with these Terms in any twelve-month period will not exceed the fees paid by you to us in that period. Neither party will be liable for indirect, incidental, special, or consequential losses, or for lost profits, revenue, or data.
These Terms apply from the date you first accept them and continue for as long as you use the Service. Either party may terminate for material breach that is not cured within thirty (30) days of written notice, or immediately if the other party becomes insolvent. On termination, your right to access the Service ends and we will delete or return Customer data as described in our Privacy Statement.
We may update these Terms from time to time. If we make material changes, we will give you reasonable notice by email or in-product message before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms and any dispute or claim (including non-contractual disputes) arising out of or in connection with them are governed by English law. The courts of England & Wales have exclusive jurisdiction.
Questions about these Terms can be sent to [email protected].
